By creating an account or using Claygen(the “Service”), you agree to these Terms of Service. If you do not agree, you may not access or use the Service. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
Claygen lets you generate 3D models from text prompts and images using AI. Generation consumes credits. Generation times, model quality, and availability may vary, and the Service may be queued or temporarily at capacity.
Claygen engines (including the model we brand as Claygen 1.0) run on a curated stack of licensed and open-source AI models and cloud infrastructure. The specific models and underlying stack may change at any time as we improve the Service.
You are responsible for activity under your account and for keeping your login secure. You agree to provide accurate information and to notify us of any unauthorized use.
Paid plans and credit packs are billed through our payment processor. Failed generations are never charged. Credits that have been consumed by a successful generation are non-refundable — they paid for compute that already ran. Promotional credits may expire or be limited in frequency. We may change pricing prospectively with notice.
Refunds.You can cancel a subscription at any time; it stays active until the end of the current billing period and simply doesn’t renew. Unused top-up pack credits never expire. If you were billed in error (duplicate charge, credits not delivered, or a technical fault on our side), contact us within 30 days via the Support pageand we’ll correct it — refund or credit, your choice. Beyond billing errors, purchases are final.
You retain ownership of the images and prompts you upload (“Inputs”) and, to the extent permitted by law, of the 3D models you generate (“Outputs”). You represent and warrant that you have all rights necessary to your Inputs and that your Inputs and Outputs do not infringe the intellectual property, privacy, or other rights of any third party.
You grant Claygen a limited license to process your Inputs and Outputs solely to operate, secure, and improve the Service.
You agree not to use the Service to create, upload, or distribute content that:
Claygen respects intellectual property rights and responds to valid notices of alleged infringement. If you believe content on the Service infringes your copyright, send a notice to our designated agent at the contact below with the information required by the DMCA (17 U.S.C. § 512).
Consistent with the DMCA safe harbor, when Claygen is notified of allegedly infringing user content and removes or disables access to it promptly, Claygen is protected from liability for that content. We may remove content and terminate repeat infringers at our discretion.
How to report. Signed-in users can flag any community post with the ⚑ report button. Rights holders can send DMCA takedown notices through our Support page including: identification of the copyrighted work, the URL of the infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act. Community uploads are additionally reviewed by a moderator before they appear publicly. If your content was removed and you believe that was a mistake, you may submit a counter-notice through the same page.
You agree to defend, indemnify, and hold harmless Claygen and its owners, employees, and contractors from and against any claims, damages, liabilities, costs, and legal fees arising out of or related to content you generate, upload, or distribute, your violation of these Terms, or your infringement of any third party’s rights. This means that if a rights holder brings a claim against Claygen because of something you generated or uploaded, you are responsible for the resulting legal fees and damages.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that Outputs are free of third-party rights or suitable for any particular use.
To the maximum extent permitted by law, Claygen will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim will not exceed the amount you paid to Claygen in the three months preceding the claim.
We may suspend or terminate access to the Service for violations of these Terms. You may stop using the Service at any time.
